Terms and Conditions (AGB) for Renting Villa Kaktus

§ 1 Scope

These Terms and Conditions apply to the commercial short-term rental of the holiday home “Villa Kaktus” located in Costa de la Calma, Mallorca, Spain. The property is rented exclusively via the platform Airbnb. The contract is concluded between the tenant (hereinafter referred to as “Guest”) and Bartlomiej Zlobikowski (hereinafter referred to as “Host”). By booking the property via Airbnb, the Guest accepts these Terms and Conditions.

§ 2 Contract Conclusion

  1. Bookings are made solely via Airbnb. The property listing on Airbnb serves as a non-binding offer. A binding rental contract is only concluded once the Host accepts the booking request on Airbnb and the Guest receives a booking confirmation.
  2. The applicable terms and conditions, cancellation policies, and payment terms are governed by Airbnb’s platform rules. These must be reviewed and accepted by the Guest before booking.
  3. The Guest has no right of withdrawal once the booking is confirmed, as per EU consumer law exemptions for fixed-date accommodation.

§ 3 Prices and Services

The valid prices, fees (e.g., cleaning fee), discounts, and all other booking conditions are stated exclusively on the official Airbnb listing of Villa Kaktus. Only the prices confirmed at the time of booking are legally binding. All prices include applicable taxes unless stated otherwise. The Host reserves the right to adjust prices and conditions on Airbnb at any time. Changes apply only to future bookings.

§ 4 Cancellation and Termination

  1. Cancellations must be made via Airbnb and are subject to the cancellation policy displayed in the Airbnb listing.
  2. In case of no-show, no refund is granted unless Airbnb rules state otherwise.
  3. The Host may cancel a booking before check-in if extraordinary circumstances make the rental impossible (e.g., force majeure, severe damage). Any payments will be refunded; no further claims are accepted.
  4. The Host has the right to terminate the agreement without notice if the Guest violates house rules, exceeds maximum occupancy, causes damage, or disturbs neighbors. No refund will be issued in such cases.

§ 5 Arrival and Departure

  1. Check-in is from 4:00 PM, check-out by 10:00 AM unless otherwise agreed.
  2. Key handover details will be shared before arrival.
  3. On departure, the house must be left tidy and broom-clean. Trash must be disposed of and dishes cleaned. Extra cleaning caused by misuse may be charged.

§ 6 Guest Obligations and House Rules

  1. The Guest must treat the property and all furnishings with care.
  2. Maximum occupancy is 8 persons unless explicitly approved by the Host.
  3. Subletting or transferring the rental to third parties is strictly prohibited.
  4. Quiet hours are from 10:00 PM to 8:00 AM. Parties are only allowed with prior written approval.
  5. Smoking is not allowed inside the house. Smoking outdoors is permitted with proper disposal.
  6. Pets are only allowed with prior written approval.
  7. Use of the pool and garden is at the Guest’s own risk. No glass items in the pool area.
  8. Any damage or defect must be reported immediately.
  9. The Host or service providers may enter the property for maintenance or emergencies with prior notice (or without in urgent cases).

§ 7 Liability

  1. The Host is only liable for intent and gross negligence. The use of the house, facilities, and pool is at the Guest’s own risk. No liability is assumed for accidents or loss of valuables.
  2. The Guest is liable for any damage caused by themselves or their companions. This includes damage to inventory, lost keys, and misuse of facilities.
  3. Guests are advised to have personal liability insurance covering damages to rented properties.

§ 8 Data Protection

  1. Personal data is processed only for handling the booking and stay, in compliance with the GDPR.
  2. The Host may be legally required to report guest data to local authorities.
  3. Data will be retained only as long as necessary and will then be deleted unless further storage is required by law.
  4. Guests have the right to access, correct, or delete their data by contacting the Host.

§ 9 Miscellaneous

  1. Minor deviations in furnishings are possible and do not constitute grounds for complaint.
  2. These Terms can only be amended in writing.
  3. If any clause is invalid, the remaining provisions remain unaffected.
  4. Spanish law applies. Jurisdiction is Palma de Mallorca, unless mandatory consumer protection laws state otherwise.
